A mining title is the concession contract granted by the Mining Authority to explore and mine minerals in a defined area, and it is the best-known structure for operating legally. It is not the only one. Depending on who applies and the status of the area, the proposal with differential requirements, the formalization subcontract, the return of areas, the operating contract or a Special Reserve Area may also apply. Mining without any of them is illegal.
From the proposal to the National Mining Registry
The concession contract proposal is filed on the Mining Authority's online platform. It must demonstrate the applicant's economic capacity and include the technical annexes and the other requirements in force. The authority then evaluates the area, checks that it does not overlap with zones excluded from mining or with other titles and, on that basis, decides whether to sign the contract. Even once signed, the contract only takes effect when it is registered in the National Mining Registry.
The area is defined on the mining grid
All applications are evaluated on the mining grid, which divides the territory into cells on which the area of each proposal is defined. That is why the polygon to be requested is checked against the grid before filing.
What to verify before filing
Many of the observations that proposals receive have causes that can be detected in advance:
- Overlaps: the area crosses environmental protection zones or current titles.
- Economic capacity: the supporting documents do not clearly show that the applicant can finance the project.
- Coordinates: the polygon has errors that change the area actually being requested.
From the area study to the filed proposal
Before filing we review the area with you, check for overlaps, evaluate the polygon against the grid and prepare the technical annexes of the proposal. We then follow the procedure, and if the Mining Authority raises observations we prepare the response and tell you from the start which deadline applies. Granting the title is the authority's decision.
