A requirement notice (requerimiento) is a formal demand the Mining Authority makes to the title holder during the oversight of the contract. It may request production information, the correction of an unfulfilled obligation, a technical clarification or the application of a measure, and it always sets a deadline for the response. So the first step is to read it in full and establish exactly what is being asked.
What the authority reviews during oversight
Oversight verifies that the holder complies with the obligations of the concession contract, and requirement notices almost always arise from one of them:
- Royalties: the holder must pay the consideration corresponding to what was produced.
- Mining Work Program: the operation must execute what was approved in the PTO.
- Environmental compliance: the project must meet the obligations of its environmental instrument.
- Production reporting: the information is uploaded to the Production Control system.
That system lets the authority compare reported production with royalties paid, and when the two figures do not match, the difference can give rise to a notice.
What is at stake if the response is inadequate
A notice that goes unanswered, or that is answered without addressing what it asks, can lead to a sanction procedure, and in the most serious case that procedure ends in the forfeiture of the title. That is why the response starts by identifying which obligation of the contract or of the law gives rise to the demand. Each point is addressed with its technical or legal support, whether maps, production reports, payment receipts or studies, and the document is filed complete and within the deadline.
From reading the notice to the filed response
We read the notice in full and identify the obligation behind it, and from the first moment we tell you which deadline is running and which documents are needed to respond. We then prepare the response with the technical and legal support for each point and review it with you before filing, so that you know what is being stated to the authority and with what evidence. Whether the response satisfies the demand is a decision of the Mining Authority.
